HB 10-1284 – The Dispensary Bill ~More Restrictions on MMJ

Governor Bill Ritter is expected to sign this bill. Be sure you understand the law and it’s impacts on you and your ability to get your medicine.

The key points:

The bill creates the medical marijuana licensing
authority (state licensing authority) in the department of revenue. The state licensing authority grants, refuses, or renews a medical marijuana center license after the licensee has received local approval. The state licensing authority also administers aspects of medical marijuana licensure, including rulemaking. Many of the functions and duties of the state licensing authority are similar to those held by the state licensing authority for alcoholic beverages.

Here are the key aspects of the law:

  • Dispensaries and edible producers will have to apply for state licenses.
  • Local cities will be able to ban dispensaries.
  • Caregivers will be limited to helping no more than five patients.

Stay tuned for more information. In light of this new red tape and oppressive government regulation, be wary of signing any contracts for medicinal marijuana.

Colorado S.B. 109 ~ A look at a potential law

Trying to keep track of all the machinations of the Colorado legislature is a full time job. By the time the casual reader looks up some bit of legislation, three more have taken its place.

Here’s a look at Colorado S.B 109, the so called Doctor/Patient Relationship Bill. The crux of the Bill is to waive the fee for indigent medical marijuana patients. But like most bills, it containst lots more than that.

The key provisions:

  • clarifies the definition of a doctor patient relationship
  • establishes the process for patients who qualify as indigent to have the annual medical marijuana registry fee waived.
